Eight years must elapse between the filing dates of the two Chapter 7 cases in order for you to be eligible for another discharge. Generally it takes about four months from the date a Chapter 7 bankruptcy is filed before a Discharge is received so since you received your Discharge in April 2004, I&#039;m guessing that your case was filed in December 2003. If so, then you would need to wait until the eight year anniversary date in December 2011 of your previous filing.
