Bankruptcy is a legal proceeding in which a person who cannot pay his or her debts can get a fresh financial start.
Bankruptcy allows individuals or businesses (“debtors”) who owe others (“creditors”) more money than they’re able to pay to either work out a plan to repay the money over time or completely eliminate (“discharge“) most of the bills.
The right to file bankruptcy is provided by federal law and all bankruptcy cases are handled in federal court.

I had a Chapter 7 that was discharged in April 2004. Do I qualify again due to my recent divorce? I am on SSI disability.
Charles,
Eight years must elapse between the filing dates of the two Chapter 7 cases in order for you to be eligible for another discharge. Generally it takes about four months from the date a Chapter 7 bankruptcy is filed before a Discharge is received so since you received your Discharge in April 2004, I’m guessing that your case was filed in December 2003. If so, then you would need to wait until the eight year anniversary date in December 2011 of your previous filing.
